Independent Contractor Agreement

Titan Chain materials and projects are subject to change based on buyer demands and quantity/size/style of items needed. We will only guarantee projects purchased if requested online through a Titancraft website. Projects must be returned within the time frame allotted and to the specifications stated in the instruction manual.

Safety

As with all wire and tools, they can be sharp and if used incorrectly they can be dangerous. Titancraft is not responsible for any injuries that occur when working with our tools and materials or when acting in capacity as an independent contractor (i.e. Titan Crafter.) Always take all proper safety precautions such as wearing protective eyewear and gloves. Keep tools and wire away from children and be careful when cutting and shaping all wire.

Indemnity

Independent Contractor agree to indemnify and hold forever harmless Titan Chains from and against any liability, loss, claim, demand and damage, including costs and attorneys' fees, resulting from or based upon any infringement or violation, default or breach of this Agreement, including without limitation the representations and warranties contained. This duty to so protect and indemnify the above shall be at all times enforced even if any incident and resultant injuries, disabilities, damages and losses were caused, in whole or in part, by the negligence, fault, or strict liability of the above or by any breach of expressed or implied warranties or duties on their part.

Independent Contractor

Independent Contractor can also be referred as a Titan Crafter, or doing freelance work and none of these terms are referred to or will be an employee of Titcancraft LLC, Titan Chains, Titan Crafter or Titan Supply Site. As Independent Contractor you are not an employee of Titan Chain, but an independent crafter who is solely responsible for your own business decisions, production and materials.

As an independent contractor no employer-provided benefits will be available; no health insurance, paid sick leave or paid vacations. Retirement must also be funded by the independent contractor themselves and unemployment/workers' compensation is not available.

Contractor's relationship with Client will be that of an independent contractor and nothing in this agreement should be construed to create a partnership, joint venture, or employer-employee relationship between the parties. Contractor is not the agent of Titan Chains and is not authorized to make any representation, contract, or commitment on behalf of Titan Chains unless specifically requested to do so, by Titancraft, LLC, in writing. The conduct and control of the work performed by the contractor under this agreement rests exclusively with the Independent Contractor.

Taxes

If they so choose, Independent Contractors are solely responsible for creating their own business entity and Titancraft LLC does not provide any advice in doing so; only by providing resources as distributed through the IRS.

As a Titan Crafter you are responsible for filing your own income taxes and maintaining proper tax records. Titan Chains does not provide any tax or legal advice we will only provide reading materials and references from the IRS, but as such we are not acting in any professional form as tax or legal advisor.

Titancraft, LLC will provide any Titan Crafter earning more the $600 in any calendar year with tax form 1099 at the end of each year as required by law. It is your responsibility for filing your own income tax forms with the IRS and for keeping records and receipts of any business tax-deductions you may choose to use.

Payment

As an independent Contractor you will earn a per-piece-rate payment and be paid a predetermined set amount for the jewelry items you properly complete based on our specific instruction. Payouts are issued on each Tuesday of every week, unless an exception is made by management to be issued on another day. Payment will only be issued once work has been deemed to meet the instructed guidelines provided.

All payouts are made via PayPal payment processing...this way we never receive or have access to any of your financial details. If you do not have a PayPal account, please apply here before your first payday. If you do not open a PayPal account we will send your payouts via company check, but please realize this method will require additional processing time. Payments made via company check will be sent by US mail and we have no control or liability if lost/stolen after our submission to the US Post Office. If you do opt for payment by company check and it is not received within in 10 business days (from date we mailed check) we will be happy to cancel and reissue another check, but a reissue fee may be assessed. Again, our preferred method of payment for completed work is PayPal, as it is safer, easier and more secure for both you and us.

Quality control will confirm that all Titan Crafters use proper supplies and materials when creating their items and they must meet the required standards set forth in Titan Chain guidelines/instructions. Any item that does not meet the stated specifications will be returned with a detailed description stating what exactly must be done in order to correct the errors and make eligible for purchase by Titancraft.LLC.

Max Postage Reimbursements is $6.00, this is enough to cover the cost of priority mail (2-3 day shipping time) for returning finished work back to Titan Chains. Shipment reimbursements will only apply to acceptable work (bracelets) that are made to our required specifications.

Security Deposit

If at any time you decide to no longer work for Titan Chains as an independent contractor simply return all tools, supplies and materials provided and at that time we will refund any security deposit that has been collected.

If you resign from Titan Chains please finish the bracelet lot you are working on and send them back with all remaining Titan Chain job kit tools, supplies and materials. You will need to complete the Material Submission 'Return' form on your job website before returning your; tool kit, unused supplies, completed jewelry and any unfinished work.

Once you have received the supplies we sent, please finish at least one lot of bracelets (4 sets) before returning your materials for a refund of your $65 security deposit. Please understand that when we ship your supplies and you do not provide us any items for resale we will be losing money in the following ways; administration costs, shipping expense, cleaning/repair of tools, repackaging/replacement of unused supplies and the loss of materials used.

This is why we simply ask that you finish the project lot you are working on, before terminating your Independent Contractor position with Titan Chains to receive a full refund of your security deposit. If you do not finish the lot you're working on and return your tool kit with unused supplies/unfinished bracelets, a 25% restocking fee will be assessed (subtracted from security deposit on file) or if any tools and/or supplies are damaged or missing a fee can be assessed up to 50% of the security deposit for your Titan Chain materials kit.

If you do not; obtain an extension from Titan Chains via written email OR satisfactorily complete the required bracelet lots in the time period given OR return the materials kit as provided, then your security deposit can be kept by Titancraft, LLC (DBA: Titan Chains) for the incurred loss of tools and supplies.

Age

Anyone participating as an Independent Contractor (i.e. Titan Crafter) must be of legal age for acting in this capacity and you must be 18 years or older to work for Titan Chains or Titancraft, LLC.

Term of Agreement

Either party reserves the right to terminate this contract any time. Titancraft (DBA: Titan Chains) can terminate an independent contractor position for any reason, we will provide notice at which time the crafter can complete any projects they may be working on or return all their tools and supplies for a full refund of their security deposit. If termination occurs and the Independent Contractor does not finish the required lots, nor returns all the tools and supplies within 30 days, they may be subject to shipping and restocking fees (up to 50% of security deposit on file.) If you do not return any of your tools and supplies, or completed work; after 60 days has passed Titancraft will keep your security deposit to cover the incurred losses and cancel your status as an independent Contractor.
